Despite many technological and medical advances, human imperfection has a tendency to intervene and can cause serious problems.  Doctors and nurses, because of their professional skill and knowledge, are held to a high standard of care.  Under the law, they are expected to exercise reasonable care under the circumstances when providing treatment to all of their patients.  When medical professionals breach or fail to execute this duty, they may be held liable for the irreparably damaging consequences of their actions.

In December of 2007, Derrick and Elizabeth Ramseyer were expecting their first child.  On December 11th, Elizabeth’s water broke and she was rushed to the Silverton Hospital in Silverton, Oregon.  She was fifteen days earlier than expected, but the medical staff took her in and began to prepare her for the birthing process.  She was given drugs to induce labor, and for 11 hours, the labor and delivery staff continued to increase the dosage.

Finally, Elizabeth was told by Dr. Denis Dalisky to start pushing, but her son’s head wasn’t positioned at the cervix.  The child’s heart rate dropped to 60 beats per minute for about six minutes.  Dr. Dalisky then decided to deliver the baby via emergency C-section.  After struggling to remove the infant from his mother’s womb, Dr. Dalisky finally emerged with the child.  However, the infant had struggled to breathe for more than 10 minutes, and required immediate resuscitation.

As a result of his injuries at birth, 7-year-old Maverick Ramseyer now suffers from cerebral palsy, a neurological disorder that hinders body movement and coordination.  Several years ago, the Ramseyer family filed a medical malpractice lawsuit against Dr. Dalisky and Silverton Hospital for the botched delivery.  They are seeking $40 million in damages for young Maverick’s injuries, as well as the expensive care that he will require for the rest of his life.  Representing the Ramseyer family in this case is Attorney Ken Suggs.
