A teenage boy in Ireland who suffered a shoulder injury at birth has settled his High Court action for €400,000. Joshua Hoare suffered an injury to his left upper arm during delivery and is now unable to play hurling, a game he loves, at competitive levels because he is unable to hold the hurley and the ball. Fourteen years after being born, Joshua Hoare, from Woodfield in County Cork, Ireland, through his mother Emma Fitzpatrick, has sued consultant obstetrician and gynecologist Rachel Patton who at the time of his birth, practiced at Bon Secours Hospital. It is alleged that at the time of Joshua’s birth Ms. Patton was responsible for managing his birth.

It was claimed that during delivery, the complication of shoulder dystocia was encountered and the baby was delivered by forceps. After delivery, Joshua’s left arm remained limp. The next day, his parents were told he had an Erb’s palsy injury. The claim further states that there was a failure to exercise reasonable care and skill concerning the examination, investigation, diagnosis, management, care and treatment during labor and delivery and also when shoulder dystocia was encountered during delivery.
