Jury Awards $3 Million In Personal Injury Lawsuit Against Doctor for Birthing Injury.

The day parents head to the hospital for the birth of their child, they generally have an expectation that they will be leaving with a happy, healthy, loving baby. The last thing on their minds is that there will be a medical mistake made by one of the hospital staff or medical professionals that will seriously injure their newborn. This, however, is the unfortunate reality for some families. If someone you know does suffer birth-related injuries, it is critical not to wait to take legal action because time could be a factor in filing a personal injury lawsuit. Our expert birth injury attorneys here at our Boston, Massachusetts law firm have spent the last three decades recovering millions of dollars in damages for our clients.

A jury issued a $3 million verdict against an obstetrician accused of forcefully pulling a baby out by his head during delivery, causing the newborn’s right arm to be paralyzed.  The lawsuit which was filed in 2014 in New Castle County, Delaware Superior Court alleged that Peter Wong, a doctor with Dedicated to Women OB-GYN, pulled too hard on the baby’s head and neck while he was trying to dislodge a stuck shoulder during delivery. That error allegedly resulted in permanent nerve damage to the baby’s right shoulder, according to court documents. Dr. Wong holds an active medical license that expires in 2019.

Three months after the birth, a pediatric neurologist diagnosed permanent nerve damage in the baby’s shoulder. Of the shoulder’s network of five nerves, two were ripped in half and the other three were overstretched to the point of not functioning properly. Two subsequent surgeries improved the arm’s mobility, but the child still has difficulty zipping his pants. He can’t ride a bike because his wrist curls inward preventing him from steering. He can’t touch his stomach with his right arm or bring it behind his head, which limits his competitiveness in his favorite sport of soccer. When he’s resting his arm, a couple fingers twitch uncontrollably
