Family Suing Over Child’s Permanent Birth Injuries.

Curshell Baum gave birth to her daughter, Hayleigh, on October 13, 2011 at the Good Samaritan Regional Health Center in Illinois. She is now suing Good Samaritan, her doctor Dr. David Walters, and Heartland Women’s Healthcare for negligence and medical malpractice.

This is because Hayleigh suffered asphyxia during her birth, and now suffers from permanent brain injuries.

Baum alleges in her birth injury claim that Walters failed to apply a fetal scalp electrode to Hayleigh’s head during labor, failed to recognize issues associated with the fetal heart monitor, and delivered Hayleigh late.

All of these factors, claims Baum, led to Hayleigh being born with hypoxic ischemic encephalopathy, a type of permanent brain injury.

The birth injury lawsuit is seeking over $675,000 in personal injury damages, including pain and suffering damages and medical costs.

The birth injury lawsuit has not yet been scheduled for jury trial.
